We see the increasing tendency that travel agencies are not letting to change travel dates for flexible flight ticket holders. For example, the consumer acquires a flight ticket for flexible travel dates and because of unplanned circumstances cannot travel. Often occurs that the travel agency denies the consumer right to change the travel dates, despite the fact that such a right exists. Even more, the travel agencies do not return money and stop communicating with consumers. EuroClaim assisted one of clients when the spanish travel agency rejected to change flight dates.

Situation
Our client acquired a flexible flight ticket from the well-known Spanish travel agency eDreams. When unplanned circumstances occurred, the travel agency was asked to change flight dates, however, his asking was rejected. The client got in touch with EuroClaim. We stepped into the dispute and prepared a European Order for Payment (Proceso Monitorio Europeo), which was submitted to the Court of 1st Instance No. 13 of Madrid (Juzgado de 1ª Instancia Nº 13 de Madrid). In our claim, we claimed to return money to our client. The court decided in our client’s favour and satisfied our claim (Decision No. 1689/2022).
