We constantly hear from our clients about Amazon account termination by error or without any legitimate reason. Sellers feel powerless when Amazon provides auto-reply messages even without looking at the situation by real people. We understand people’s frustration when their business stops and it seems nothing can be done to get out of the blind spot.
Amazon’s Conditions of Use are very laconic and in section 7 is stated:
“We reserve the right to refuse any Amazon Services or terminate accounts if your behaviour gives justified reason to do so. This will in particular be the case if you are in breach of applicable laws, applicable contractual provisions, our guidelines or our policies, which are all accessible on the website. Notwithstanding any such limitation or termination, you will continue to have access to content and services purchased by you up to that point.”
However, we have to remind you that Conditions of Use it’s only a contract between Amazon and the Seller and they are not absolute. Therefore, such a statement of Conditions of Use as: “We reserve the right to refuse any Amazon Services or terminate accounts if your behaviour gives justified reason to do so” is very wide and indefinite. If Amazon account termination applies and if they reasoning this under the above-mentioned clause from Amazon Conditions of Use, it does not mean that they have a right to do so. Amazon account termination should be justified and legitimate. Such Amazon decision must comply not only with their Conditions of Use but also legal requirements established by Luxembourg legislation.
