Situation description:
The customer bought a 1-month subscription from a broadcasting service provider. The services were automatically renewed next month and the customer was charged for an additional 1-month subscription.
After the re-charging (in 14 days), the customer informed service provider that he is not willing continue to use the services and asked for the refund. EuroLeagueTV denied the customer’s right of withdrawal from the contract. The service provider grounded its denial under the condition that the customer is not eligible to the right of withdrawal from the contract because such right is not established in the Terms and Conditions.
The customer contacted EuroClaim for the assistance in this dispute. We analysed current consumers rights legislation and came to the opinion that the broadcasting service provider abused its rights to provide the right of withdrawal.
EuroClaim brought the claim to the JUSTICE DE PAIX DE LUXEMBOURG. The court decision confirmed our position and the rights of consumer were protected. Therefore, EuroLeagueTV had to refund the customer for unreasonably charged services.
